That the Charter excluded ‘enemy States,’ and that the San Francisco Conference on International Organization did not include various States that had remained ostensibly neutral during the war, also supports a restrictive interpretation. Yet restrictions on membership did not prevail. By the mid-1950s, famously, they disappeared almost entirely. This is a story of policy judgments, especially the judgment that to achieve and keep international peace and stability requires an organization of universal membership.

As will be seen in connection with treatment of the former Yugoslavia (Chapter 6), this is consistent with the relation between State succession and UN membership generally. The constitutional apparatus of Article 4(2) has been further specified in UN procedure. 59 An application for admission, ‘[u]nless the Security Council decides otherwise,’ is to be referred for further examination 54 55 56 57 58 59 SC res 158, 28 Sept 1960. ’ The letter and resolution 158 were distributed under the title ‘Application of the Republic of Senegal for Membership in the United Nations’: A/4513.
